Counsel
 
The NYS Office of Indigent Legal Services (ILS) was created by the 2010 enactment of Executive Law § 832 (Office) and § 833 (Board), with the mandate “to monitor, study and make efforts to improve the quality of services provided pursuant to article eighteen-B of the county law.” Since its inception and under the Board’s guidance, the Office has made significant progress in reforming New York’s long-neglected county-based system for providing public criminal defense and has laid the groundwork for reforming its even more deeply neglected county-based system for providing public parental representation. The holder of this position serves as agency Counsel (“Counsel”) under the direction of the Office’s Director and works closely as the Director’s advisor on intergovernmental, legislative, and Office issues. Counsel oversees the Office’s operational, programmatic, and research functions, and plays a key role in integrating these functions as the Office’s responsibilities expand and number of staff increase.
 
Specific responsibilities for this position include the following:    
  • Advise the Director as to overall Office planning and strategy, including Office operations, intergovernmental relations, quarterly Board meetings, and any legal concerns affecting the mission and operations of the office. 
  • In collaboration with other staff, serve as a liaison to State agencies, associations, and local governmental entities, including local and state officials, to identify opportunities for the Office to enhance intergovernmental relations. 
  • With the assistance of the Administrative Officer and Assistant Counsel, manage the annual State Budget process, including preparing and overseeing the submission of the Office’s annual Budget Request, collaborating with key fiscal and programmatic State agency and legislative staff on the Budget Request, responding to requests for information, providing overviews of Executive and legislative budget proposals, and preparing written Budget testimony and final Budget summaries. 
  • Supervise the Chief Hurrell-Harring Implementation Attorney in implementation of the Hurrell-Harring v. State of New York Settlement, and the Chief Statewide Implementation Attorney in the Settlement’s expansion to the entire State via Executive Law § 832(4). 
  • Supervise the Director of Research in the development and implementation of programs of quantitative and qualitative research and data collection in fulfillment of the Office’s statutory requirements, and the Manager of Information Systems in maintenance of the Office’s technological functions and website. 
  • Supervise Assistant Counsel in providing oversight and guidance to the Grants Manager for reimbursement and structured payment and contractual processes for contracts entered into by the Office and the State procurement process, including ensuring compliance with state procurement guidelines for non-competitive and competitive grants, such as Requests for Proposals (RFPs). 
  • Supervise the Administrative Officer in managing the operations of the office, including the management of human resource functions and the State Operations budget. 
  • With the assistance of Assistant Counsel and the Administrative Officer, serve as the Ethics and FOIL Officer of the agency. 
  • Undertake such other activities as may be requested by the Director in furtherance of the Office’s overall responsibility to make efforts to improve the quality of mandated representation under County Law Article 18-B.

Requirements Juris Doctorate, admission to or willingness to seek admission to New York State Bar; a minimum of eight years’ experience in the provision of public criminal or Family Court representation, legislative experience, or other related experience; and a minimum of five years’ experience as a supervisor or manager. The ideal candidate will demonstrate commitment to quality public defense, leadership skills, sound judgment, strong oral and written skills, and experience and willingness to collaborate with people who have diverse backgrounds, experiences, and roles in local and state affairs. Experience and familiarity with quantitative and qualitative research and data collection is preferred, but not required. Statewide and local legislative and other relevant experience for performing the essential duties of the position may be considered.
