Assistant Public Defender: Forensic Science Litigation Support Attorney
The Maryland Office of the Public Defender seeks a zealous, client-centered attorney to serve as a Forensic Science Litigation Support Attorney. The Forensics Division of the Maryland Office of the Public Defender (OPD) is a state-wide specialized division that provides support services and training to OPD and panel attorneys in forensic sciences.  The Forensic Science Litigation Support Attorney provides specialized support to attorneys related to the legal framework for admissibility of expert opinion and scientific testing, (including disclosure and discovery issues), and procedural and substantive issues related to development of theories of defense. OPD will consider candidates of all experience levels for this position. The projected start date for this position is flexible with a preference for early 2022. This position is located at 6 St. Paul Street, Baltimore, Maryland and is currently a hybrid role.

Primary Duties and Responsibilities:
  • Support and collaborate with OPD and panel attorneys related to all aspects of forensic evidence and expert testimony,[1] including: review of case-related discovery,      identification and consultation with independent experts, development of legal strategies and defenses, and related litigation.
  • Litigate complex challenges to forensic science evidence.
  • Assist in developing and conducting training programs.
  • Consult with our governmental relations team and legislators related to policy issues pertaining to forensic evidence.

  • Significant criminal defense litigation experience with extensive experience utilizing forensic science experts (preferred).

  • Strong communication and interpersonal skills including the ability: (1) to simplify and explain complex forensic ideas, and (2) to communicate effectively with a range of audiences including people with different backgrounds and lived experiences.

  • Exceptional organizational, legal, and administrative skills necessary to manage multiple projects simultaneously.
  • Demonstrated commitment to serving communities who have been pushed to the margins.

  • Active membership in good standing in the Maryland Bar or Bar of another state.[2]
[1] Some of the more common areas of forensic science that the Litigation Support Group handles include: DNA, digital evidence (cell phone location data, forensic extractions of digital media storage devices, surveillance video/audio), medical (cause and manner of death/child abuse), toxicology (human specimen/CDS testing), pattern impression (latent fingerprint, firearm/tool mark, handwriting), accident reconstruction, forensic interviews of children, and crime scene reconstruction.
[2] Attorneys barred in another state must become members of the Maryland Bar within 18 months of start date.
